I (Aaron Russo) set out on a journey to make a film about whether or not there was a law requiring Americans to pay income tax..or was the tax a fraud being perpetrated by the federal government. [After a six-year battle with cancer, Aaron Russo died on August 24, 2007. Rest easy my friend.]

This process of discovery brought something much more dangerous and frightening to my attention... now I bring it to yours.

In 1913 America was a free country.  Then a band of powerful bankers achieved their fathers and great grandfathers goal.  —America has never been the same.—

Soon the world will not be the same.

In 1913 Woodrow Wilson was president. Powerful banking interests achieved their goal. J P Morgan, Paul Warburg, John D Rockefeller.

“First they convinced then secretary of state Knox to lie to the public, he reported that the 16th amendment was ratified, but it was not as cited in recent court cases.“

That same year (1913) bankers committed their second and most diabolical fraud, they bribed senators to pass the Federal Reserve Act without a constitutional amendment.  They did this during Christmas Vacation when many senators were home celebrating the holidays with their families.

“They were very clever and they understood that whoever controlled the money would control the government.  Whoever controls the money controlled the government.  The government had given away one of its most important powers and now how had to borrow money from them and pay them interest.  The bankers won, they knew most politicians would sell their soul for a dollar.”

“Give me control of a nations money supply and I care not who makes its laws.”  Mayer Rothschild, Pvt.  Banker. Now the government would have to borrow money & pay interest which reduced the standard of living and pay a graduated income tax just so the government could pay these bankers.

Woodrow Wilson 1919; “I am a most unhappy man.  I have unwittingly ruined my country.  A great industrial nation is now controlled by its system of credit.  We are no longer a government by free opinion, no longer a government by conviction and by vote of the majority, but a government by the opinion and duress of a small group of dominant men.”

Ben Bernake, Federal Reserve Chairman; "The federal reserve was created by congress in 1913 and it was entrusted with the power granted originally to the congress by the US  constitution to coin money and regulate the value there-of."

Income tax is illegal because it is not a direct tax or an apportioned tax as the constitution demands.

“The power to tax is the power to destroy,” Supreme court chief Justice John Marshall.

John Turner, an IRS agent spent 3 ½ months trying to find something that said income tax was legal but he could not find the statute that gave the IRS the authority.  He didn’t then nor has he since.

Joe Banister and IRS Criminal Investigator had to quit because he presented evidence that I had accumulated that the IRS was violating the law, violating people's rights and committing fraud.  He asked the agency for a sincere response to his concerns and the IRS presented Joe with papers of resignation.

Sherry Jackson, former IRS agent  “We the People,” foundation put a full page ad in USA Today in July 2000 offering $50,000 to anyone who could show the law that allowed taxation.  Sherry Jackson, former IRS agent thought she would kill two birds with one stone in that she was repeatedly asked about the law and she could use the $50,000.  Based on research she did and still doing, she has not found that law despite asking ‘experts’ e.g. congress, IRS commissioners, nobody will answer because if they did then everyone in the US would know it was a fraud.

There is No Law requiring a US citizen to file a 1040.

67 million people do not file a return.

“We the People,” foundation presented a lawsuit against the IRS signed by 3000 people.  Bob Schultz founder said income tax was the greatest fraud ever perpetrated against the American worker.

Bob Schulz of “We the People” foundation.  “Most people believe that the income tax system is legal and that the revenue of the tax is used in the public interest.  However there is a substantial conclusive body of evidence that proves that our income tax system represents the most pernicious form of tyranny.  It is the greatest hoax ever perpetrated by a government against the working men and women of America.

Charlie Beal - of ‘We the People Foundation’ “American citizens along with the foundation asked the IRS to specifically provide us with the underlying legal foundation upon which they administer and enforce the income tax in our country.

Marl Everson, IRS commissioner when asked if taxes were legal replied that he had been paying ever since blah blah blah but he never answered the question. He never really answered the question.

Joe Bannister and I (Bob) had a meeting in the White House with President Clinton’s economic adviser Jason Fermon, he accepted the remonstrance for the president, on June 2nd I called and spoke with him, his words were “we have decided that the issue of the legality of the income tax is not a high priority matter with the White House and we will not be participating in any conference on this subject.”

“We can’t be so fixated on our desire to preserve the rights of ordinary Americans.” Bill Clinton, March 11, 1993.

Dole Hart IRS commissioner.  Refused to answer any questions on the matter..

Mark Everson the IRS commissioner gave a bunch of double talk but would not answer the question.  Why didn’t he answer the question?  Apparently there is no law.

Joe Barrister, “If Americans just learned the IRS was knowingly deceiving them, that would be enough for them to rise up and put a stop to it.”

Roscoe Bartlett (R-MO) said they had secured the agreement of the IRS and the justice department because some of the issues are beyond the preview(?) of the IRS and they would both attend a public symposium where these issues would be formally addressed.

Last thanks giving both the DOJ and the IRS notified congressmen Bartlett they would not be participating. Congressmen Bartlett than waited until late January to informed me (Bob) that he would not be participating.

David Cay Johnston of the NY times ask Terry Lemons “Why won’t the IRS answer the question set forth in the petitions from the American People?
Terry Lemons: “The government is answering the petitions, through enforcement actions in the courts.” 

Aaron: “This is a very chilling remark on the government's use of Brute Force instead of servility and logic.”

Charles Bell, “The Federal Government refuses to provide the American people who are cohesively being subjected to this extraction of their private property without any underlying justification.  There is no law, There is no law  that requires any US citizen to pay a direct unapportioned  tax on their wages in compensation for their services.   There is no law.”

Charles Bell served a complaint on behalf of the American people to the Internal Revenue Service.  The IRS accepted the claim and said the case had been filed, we will call you with a case number.

On August 31, 2005 federal judge Emmet Sullivan ruled the government does not have to answer to the American people questions, even though it is guaranteed in the First Amendment.

Our courts have made a decision that the government does not have to show the law that it enforces and the press has never reported on this.  Have we given this judge the authority to overrule the constitution, the very foundation of American rights?

Catharine Austin, former assistant Secretary of housing: Every year you give the government a form that if you lie could get you into prison.  And under the law they give you a statement back telling what they did with your money.  Fiscal 1999 military had 1.1 trillion dollars of un-accountable adjustments...  One year later the number was 2.3 trillion. After interest payments and government waste not one penny collected from the tax on your labor pays for the services you expect from the government.

Aaron called the IRS (in Washington DC) & spoke to Anthony Burke in media relations & he explained that no one would go on TV to discuss taxes but he said he would call back.  He did, but only with a list of other people to call..
So he (Aaron) went to the IRS building to see if anybody would talk to him there.  He was met outside by security who told him he had to leave.  Aaron kept asking under what law was he being asked to leave and the security eventually called Homeland Security.  Who was he threatening?

Meet the Tax Experts

State Rep Phil Hart (R-Idaho) said that there was no law that requires paying income tax.
Larkin Rose - Tax honesty  - law allows only two kinds of taxes; direct and indirect.
Irwin Schiff - Author says congress can tax as long as it is apportioned.
    A direct tax must be apportioned.  - US constitution
        apportion: to divide equally amongst the people
    The indirect tax: e.g. excise tax on gasoline or tobacco.
    The indirect tax must be uniform (the same) throughout the US. - US constitution
Vernice Kuglin of Tax honesty says income tax does not meet the criteria for either tax.  The Rushaver case also said the 16th amendment does not allow for any new taxes.

Supreme Court in Stanton verses Baltic Mining, “the provisions of the 16th amendment conferred no new form of taxation.”
Congress tried to enact an income tax in 1894& the supreme court struck it down saying it was unconstitutional.  Congress tried again in 1913 & again the Supreme court said the 16th inferred no new taxes.

Income means a corporate profit, not taxes on labor.  In 2005 the illegal tax collected 927.s billion.   The legal corporate income tax collected was 278.3 billion.

Aaron, “The reason for this is there are a number of people who do not think it is legal to file income tax and there are many people going to jail for it, fighting over it.”
Sheldon, “the internal revenue code is authorized by the 16th amendment.”
Aaron, “I think it should be clarified, I think government should be transparent to the people.  Why doesn’t the IRS commissioner just sit down with them and explain it?”
Sheldon, “I don’t think they care, I think they are just playing word games.”
Aaron, “you don’t think they are sincere people?”
Sheldon, “No, I don’t.”
Aaron, “What does voluntary compliance mean, and what does the IRS code say, ‘it is voluntary to comply, it is not mandatory’
Sheldon, “That is a euphemism we use when we talk about traffic signals, most people, at 2 o’clock in the morning, do you stop at a traffic light?”
Aaron, “yeah.”
Sheldon.  “Is there a cop there?  Most of us do.  But that is voluntary compliance.”  

Aaron (narrating) that was a complete perversion of logic.  Traffic laws state that it is mandatory to stop at a (red) traffic light, the IRS code says it is voluntary to comply.
    Voluntary adj.  1.  An action undertaken of one’s own free will.
    Mandatory adj.  1.  Commanded by authority.

“Your income tax is a 100% voluntary tax and your liquor tax is a 100% enforced tax.  The situation is as different as night and day.”  –Dwight E Avis, Head of the Alcohol and Tobacco Tax Division, Bureau of Internal Revenue.

Aaron, “So can the government criminally prosecute you for whatever you put on your 1040?”
Sheldon, “Yes.”
Aaron, “Why, doesn’t that defy the 5th amendment?”
Sheldon, “No.”
Aaron, “But the 5th amendment says I don’t have to say anything to incriminate myself.”
Sheldon, “Well it doesn’t incriminate to put your income down.”
Aaron, “Well you said before I could be put in jail for it.”

Aaron ‘The commissioner wants us to believe that although the IRS demands you fill out the 1040 and you can go to jail for it that they are not violating your rights of self incrimination.  That is absurd.’

Back to the interview

Aaron, “Isn’t it true that the word ‘income’ is not defined anywhere in the revenue code?”
Sheldon, long pause “the law says the government has the right to tax income from any source derived.”
Aaron, “So the word ‘income is not defined anywhere in the code, it just says ‘income’ without any definition of what income is.”
Sheldon, “That’s right”
Aaron, “correct?”
Sheldon, “yeah.”
Aaron, “But there are many different kinds of taxes.  How can an American citizen know what income is if the code doesn’t define it?”
Sheldon, “Because the courts have defined it.”

Aaron, ‘Do you remember what constitutional Attorney Edwin Verra said?  “The definition of income in the constitution was given in the Iseman verses Montgomery case, and it turns on gains or profits that were made with some activity.”

So the supreme court has ruled, income is not wages or labor, it is gains from corporate activity.

Aaron, “I believe that a man’s labor is his private property.”

Sheldon, “That’s your view, but it is not the law..”

The Supreme court has even said that your labor is your private property.

“Chief among such contracts is that of personal employment by which labor and other services are exchanged for money or other forms of property.”  Coppage v.  Kansas, 236 U.S. 1, 14(1914)

Aaron, “In 1916 we had the Brashire and the Stanton  Case which said the 16th amendment gave the government no new power.”
Sheldon, smiling, “I’m not going to argue the niceties of that with you.”

Larken Rose, tax Honesty, “and it came up again in a case called Peck v Lowe where the supreme court said the 16th amendment did not extend congresses taxing power to any new or accepted subjects.   In other words if you weren’t taxable before the 16 you weren’t taxable after the 16th .”

Aaron, “Today I interview a juror who sat on a case and the found person not guilty for lack of filing, OK, and I asked her why they found them not guilty and she said because the IRS couldn’t show us the law that made him liable to file a 1040.”

Sheldon, “Title 26 requires you to file a return.”
Aaron, “Doesn’t title 26 have to be in compliance with supreme court decisions?”
Sheldon, “Your going to take a 1920's case and superimpose it on the whole internal revenue code that was written after it?  No, that that’s not —“

Aaron, I can’t believe what I just heard.  Remember he said earlier that the internal revenue code was authorized by the 16th amendment?  Remember the Supreme Court said the 16th amendment did not give the government any new taxing power.  These decisions have never been overturned.

Aaron, “Can the lower courts overturn the supreme court?”
Sheldon, “No.”
Aaron, how is it they are putting people in jail for not paying their taxes on their labor when the supreme court said they don’t have to?
“Doesn’t the IRS code have to be in compliance with the supreme court?  That is my question”
Sheldon, “This is a waste of time, because whatever I say your not going to believe—“

He’s right, I don’t believe him and neither should you.  He wants us to believe we should obey the IRS code which is being enforced in violation of the many supreme court decisions.

Sheldon, “thank you but I think we are finished.  I’m sorry that you constantly re-argue the point.  —  Supreme Court decisions are inapplicable”   

Aaron, He just said the supreme court decisions do not apply to the IRS.  That is the behavior you would expect from a totalitarianism country, maybe China or Russia or Cuba, not from America..   They are just making up the law as they go along.  Now I knew the tax honesty movement was right.  The IRS thrives on intimidation and fear, not by law.  It is no different then a criminal protection racket using force to extract your money from you.  Then the former IRS commissioner, now working at a prestigious NY law firm, threatens me.

Sheldon, in Yiddish, “nothing will help you.”

There is no law that requires you to pay income tax.
The US constitution forbids a tax on wages and salaries of its citizens.
The United States supreme court has consistently ruled that a income tax is a tax on profits and gains, not a tax on labor and wages.

Craner, “Right, and, I talked to my boss about that and he said my badge is that.”
Whitey, confirming, “Your badge is your authority.  I thought it had to be in writing”

During the trial they ask the agent Craner if he wrote any of this down and he looked right at the defense attorney and said no he didn’t, a lie; as it clearly is in the video.  Craner was under oath, yet he was clearly lying in court, the judge could see it, and nothing was done.

Whitney, to Craner “Under what is the requirement, that you claim, I’m required to do these things and the requirement under the regulations is what section?”  – What particular acts are we discussing here that you claim I’m liable to do?”
Craner, “Your exact question would be again? — What is the section that what?  – I guess I’m still not understanding your question Mr.  Harrell.”
Whitney, “You must be familiar with the police powers you have to enforce.”

The prosecutor in the trial had no come-back so he started slandering Mr Harold.

Sherry Jackson, Former IRS Agent, “They are calling us tax cheats, they are calling us fanatics, they are calling us weird-o’s.  I don’t care what you call me but I have one question, ‘Where is the law?  Show me the law”

Larken Rose, Tax honesty, “They can’t let this turn into a rational debate because if they do they will lose it.  So they have to insult people to say it is frivolous.”

When it came time for deliberations the Judge told the Jury, “I will give you the law.”  He never did, even when asked again during deliberations.  The Jury found the defendant not-guilty.

In 2004 the IRS arrested IRS agent Joseph Bannister for telling people the truth about the income tax laws.  The Jury obviously agreed with Joe.

But what does the media say?  “Tax Evaders Win a Case Over I.R.S.”

Vernace Couglin a Federal Express pilot claimed there was no law requiring Americans to file an income tax.  She also won in court.

24 people were charged by the IRS in a single court case and won in court because the IRS cannot show the statute that required filing an income tax return.  The IRS doesn’t do trials with multiple parties anymore because the defendants are able to pool their money and get good representation.  They prefer to rule by intimidation.

TV show 60 minutes interviewing Charles Rossotti, Former IRS commissioner, “When the matter is put to the test which means in court and enforcement action, there is %100 success rate in shooting down these arguments.

Jennifer Long, IRS agent, “The mafia has a code and they follow it and it is a code of honor, but the IRS has no code of honor.”

“The IRS selectively audited taxpayers who were poor and vulnerable...They routinely fabricated evidence against taxpayers...They encouraged agents to ‘stick it’ to taxpayers.”  Jennifer Long, IRS agent.

Judge Dawson a federal judge presiding over the Irwin Schiff tax case who denied Erwin the ability to prove to a jury that there was no law that required Americans to pay an income tax.  He denied Irwin the right to prove his case by stating, “I will not allow the law in my courtroom!”  That the judge made sure the government never had to show the law is written by telling the jury “You must follow the law as I give it to you.”

The lower courts will not allow citizens, especially in tax cases, to bring in supreme cases as evidence for their cases.

Irwin, “the Supreme court is irrelevant??”
Judge Dawson: “Irrelevant!  Denied!”

Here is a federal judge railroading an American citizen by saying supreme court decisions are irrelevant.  Again, nothing from the press, defending our freedoms.

Irwin Schiff was found guilty and sentenced to thirteen years in prison for a non-crime.

Check how the US screwed over JOE Lewis after he was being so gracious of donating his fees. The IRS confiscated Joe’s children’s trust funds for taxes on money he gave to charity.

The IRS raided a couples home (John Colaprete, “Jewish Mother” Owner) simply because their bookkeeper said they were drug dealers and tax cheats.  That is the only thing the IRS went on for a raid to their business.  They raided 4 locations besides going to John’s home and literally pulling him out of the shower.  They wouldn’t allow the family (wife and daughter) privacy to get dressed.  The government kept everything they took in the raid in a van and wouldn’t allow any of it to be returned for 5 months.  The IRS filed no charges, they just kept everything.   They drove the business into the ground, the daughter lost her college fund.

Our freedoms stopped when America adopted one of the major planks of the communist manifesto, a centralized bank.  The very same people that back the federal reserve also back the graduated income tax a second part of the Communist manifesto.

Michael Ruppert, Investigator/Author, “The government borrows money from a private corporation using the name ‘Federal’ & the United States on it and then it pays back to the Fed which is owned by private banks that we don’t know who all those private banks are but the money is paying back to the private bankers is the money that comes from you and me.  The Federal Reserve is no more Federal than Federal Express.  I’ve never seen a full list of ownership for the Fed, I don’t think anybody has.

Why does the government borrow money from a bank when it has the authority to make its own, interest free?

Catherine Austin Fitts, former Asst.  Secretary of Housing, “The government works for a private bank and the private bank works for its owners....The true masters.”

Ruppert, “People talk to me about the problem of republican verses democrat but they don’t get it.  I said look, here is the way to look at it,  It is organized crime.  All you do is call the Republicans the Genovese and the Democrats the Gambinos... The people at the top treat it like a crap game.  It is their crap game and they are making lots of money.  Occasionally at the table somebody shoots each other but the moment anything threatens their crap game they all unite to protect it....They are both controlled by the same financial and corporate interest.

What really most of the people in America have come to be is ‘food’ for the debt machine.

New bankruptcy laws now make it impossible to get out of debt, debtors prison.  Credit card interest rates 20% & higher...The Democrats and Republicans work with the banks...

Edwin Vieira, Prof.  Constitutional Law, “The powers that be  in the system, the financial interests are able to exercise a disproportionate amount of influence, not only on the economic structure of the country but the political structure.”

President Bush has signed executive orders giving him sole authority to impose martial law and suspend habeas corpus.  This gives him dictatorial power over the people, without any check and balances.

Congressman Sensenbrenner’s bill (HR 1528) requires you to spy on your neighbors, including wearing a wire.  Refusal would be punishable by a mandatory prison sentence of at least two years.

During the 1990's President Clinton monitored millions of private phone calls placed by U.S. citizens.  He did this under a secret program code named Echelon.  The widespread use of wiretapping Americans during the Clinton administration proves this practice was not started because of 9/11 but is standard procedure.
